General Conditions of Sale (GCS) – Red9 Performance

2. Product

The product marketed is the “EXHAUST PRO ® ” exhaust valve, designed to reduce the noise level of a motorcycle exhaust.

Attention :
The EXHAUST PRO ® product is not approved for use on public roads.
It is strictly intended for use on closed circuits or private roads.

3. Scope of application

These T&Cs apply to all sales concluded by Red9 Performance with consumers or professionals located in France.

4. Order

Any order constitutes full and complete acceptance of these General Terms and Conditions by the customer. The sale is considered concluded upon confirmation of the order.

5. Price and payment

Prices are indicated in euros, all taxes included (TTC), excluding delivery costs.
Payment is due immediately upon ordering.

6. Delivery

The products are delivered to the address indicated by the customer at the time of ordering.

If Installations in an approved center EXHAUST PRO ® will be sent directly to the Approved Center.

We are not responsible for the installation times of our centers which may vary depending on their schedules.

Delivery times are given as an indication and may vary.

7. Right of withdrawal (Individual customers only)

In accordance with the law, the individual customer has a period of 14 days from receipt of the product to exercise his right of withdrawal, without having to provide reasons.

Return costs will be borne by the customer and shipping costs cannot be refunded, only the price of the product.

8. Warranty and exclusions

The product is guaranteed against any manufacturing defect for 1 year from the date of purchase.

The warranty does not cover:
• Incorrect installation or installation that does not comply with the recommendations,
• Use on open roads in violation of regulations,
• A modification of the product,
• Mechanical or electronic damage due to improper use.

9. Limitation of liability

Red9 Performance declines all responsibility in the event of:
• Damage to the engine, exhaust or other mechanical or electronic components related to the use, installation or modification of the Exhaust Pro valve,
• Failure to comply with regulations in force concerning noise or use on public roads,
• Use on open roads, which is strictly prohibited.

The purchaser expressly acknowledges that the Exhaust Pro product is intended exclusively for use on a circuit or private road.
Red9 Performance cannot be held responsible for any infringement or damage resulting from improper use.

10. Intellectual Property

All elements of the site, the Red9 Performance brand, the Exhaust Pro product as well as the technical documents are protected by intellectual property law.

11. Applicable law and competent jurisdiction

These T&Cs are governed by French law.
In the event of a dispute, the French courts will have sole jurisdiction.
